The Failure of the 28-Clause Peace Initiative for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the crisis caused by the presentation of a new comprehensive peace framework for ending the war appeared – momentarily – to have been stabilised. A Washington representative spoke of "substantial progress" after Ukraine-US talks in Geneva. On Monday night, Russian leadership made its retaliation: an extensive attack of aerial bombardment on Kyiv.

The Rhythm of Negotiation and Warfare

The sequence of conflicting incidents captured the harsh reality of the outgoing year. By day, diplomatic battles are fought: hopeful statements are released from various governments. Significant resources is devoted on managing specific proposals. By night, the Kremlin forcefully demonstrates the world that, for them, military action persists as the main instrument for achieving "resolution".

After-Dark Attacks

As the offensive unfolded into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was laid bare. Ukraine is capable of detecting projectile deployments from across the border, a capacity enabled by current data. From observation points, Ukrainian air force fighter jets that had been deployed to intercept incoming cruise missiles flew past – advanced fighter aircraft provided to Ukraine by Western partners.

Shortly after, Kyiv's missile defense engaged: several firings deployed against a hostile projectile. This was a sophisticated defense system at work, most likely provided by partner states. Every launch creates sudden vibrations, rattling buildings. The moment of terror quickly becomes grim resignation: maybe the incoming missile won't strike its target this time, sparing the city from devastation and another blackout.

Persistent Threats

Following this, a large-caliber weapon opened up on a drone in the vicinity, part of a mobile-fire group – almost certainly allied-provided weaponry. Unfortunately, the projectiles didn't strike the enemy aircraft – it continued its flight toward its destination.

Intermittently, this carried on until dawn. Kyiv faced the daybreak reports: several casualties, devastation and utility failures in many homes as a result of the evening attack. As always, everyone still continued their routines – living the war. But those entire period illustrated Ukraine's critical military reliance on Western support – a dependence that regional partners are clearly incapable to replace in the near term.

Ineffective Peace Efforts

The detailed framework from US administration sparked intense emotion, controversy and profound anxiety – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and bilateral conferences.

Every new proposal from Washington unfolds according to the identical sequence: a negotiation push against Ukraine, which Kyiv, with allied governments, effectively counters. They stabilise the situation but never actually achieve victory. This pattern will, no doubt, persist.

Strategic Calculations

It is easy to blame particular leaders of persistently promoting Moscow's conditions. But that does not seem to be the entire situation. Washington functions according to a assumption well known to seasoned negotiators: you cannot achieve through diplomacy what you have been unable to protect through force. The US administration presumes that it is unrealistic to force Russia to surrender the territory that it already controls in Ukraine's occupied territories.

The issue is that while accepting these circumstances, American administration does little to discourage Russia, through diplomacy or military means, from thinking that the current condition will not change more in its favour in the months ahead.

Opposing Positions

Therefore, the Kremlin is confident that time is on his side – that Ukraine and its supporters are coming close to fatigue. Their motivation to sign a deal that does not give them the greatest potential benefit is virtually nonexistent. There may be multiple initiatives to stop fighting, but they will continue as long as Russia's leadership remains completely certain in the outcome.

On the contrary, Ukraine's government believes that Ukraine can still endure, gradually sacrificing civilians and areas but preventing a total frontline collapse until situations evolve in its advantage.

Current Realities

Objectively, there are no real preconditions for a truce. Now, individual motivations are becoming relevant: leadership ambitions to negotiate peace and secure international recognition, and the government's twin challenges – on one hand, not to estrange crucial supporters, and on the other, to mobilize citizens around the flag against any initiative Kyiv finds unworkable, so that their attention does not shift toward homefront challenges. And although their task will now be considerably more difficult after current events, it remains quite doubtful that this will modify their basic position.

These opposing factors are driving the talks.

Conclusion and Outlook

It took a mere seven days to eliminate the proposed articles of the most recent proposal. Aggressive and erratic handling of the matter by US administration, pushback by Ukraine and the other European countries, along with soothing efforts of negotiators, and finally, recent disclosures, all achieved their purpose.

While new proposals based on old ideas are forthcoming, Kyiv, London and other European capitals should reach an essential realization: Ukraine and Europe will only be able to resist political attacks from Washington that are based on Russian demands and reflect specific hesitation to modify developments, if they stand together and improve their protective measures at a much faster pace. If they do, neither political nor armed coercion will be able to overcome them. In the meantime, Ukraine's capacity to repel nightly air assaults will, for the predictable period, mainly require continued Western support.
